Terms and Conditions

General info

These terms and conditions apply to the entire website of Atelier Jupe. These conditions are accessible at all times and for everyone and are all included on the Atelier Jupe website. By placing an order you agree to be bound by all the delivery and payment conditions. We reserve the right to change services, delivery and/or payment conditions and all terms and conditions in general.

Delivery

All deliveries take place while supplies last. The delivery time only starts after we received the invoiced amount. The stated delivery times are not binding, but purely indicative: no delay in delivery can lead to the termination of the purchase or payment of damages for the benefit of the buyer. Atelier Jupe has the right to make partial deliveries. In the event of non-delivery of the goods, any amounts paid by the buyer will be reimbursed without interest or other compensation. Atelier Jupe's obligation to deliver will, subject to proof to the contrary, be fulfilled as soon as the goods delivered by Atelier Jupe have been offered to the buyer once. In the case of home delivery, the report of the carrier serves as complete proof of the offer to deliver. Incorrectly supplied delivery addresses are the responsibility of the buyer and may give rise to additional costs. The shipment of the order is entirely at the risk of the buyer. If a package needs to be sent with insurance, the buyer must contact Atelier Jupe in advance.

Pricing

The prices are those as stated on the website at the time of the order. All prices on the website are in EURO and include 21% VAT.

Privacy policy

If you place an order with Atelier Jupe, your details will be included in the Atelier Jupe customer base.

 Disclaimer and indemnity

Atelier Jupe guarantees that the products supplied meet the requirements of usability, reliability and service life as reasonably intended by the parties in the purchase agreement. Atelier Jupe is not responsible for the ultimate suitability of the goods for each individual application by the customer, nor for any advice regarding the use or application of the goods. If complaints from the customer are found to be justified by Atelier Jupe, Atelier Jupe will either replace the delivered goods free of charge or make a written arrangement with the customer about compensation, on the understanding that Atelier Jupe's liability is limited to the invoice amount of the relevant matters. Any liability of Atelier Jupe for any other form of damage is excluded, including additional compensation in whatever form, compensation for indirect damage or consequential damage or damage due to lost profit, or damage to other objects caused by improper use of the products. The colour of the fabrics as depicted on the website cannot be guaranteed by Atelier Jupe due to elements that are beyond our control such as different computer settings.

Offers

Offers are without obligation, unless otherwise stated in the offer. Additions, changes and / or further agreements are only valid if agreed in writing. For gift vouchers, the conditions and terms as stated on the receipt apply. Different offers and promotions cannot be used together. Only 1 discount offer can be used per order.

Mutual agreement

An agreement between Atelier Jupe and a customer is established after an order has been assessed as feasable by Atelier JupeAtelier Jupe reserves the right, without giving any reason, not to accept orders or assignments or only to accept them under certain conditions.

Pictures

All images, photos, drawings, data regarding weight, dimensions, colours, images of labels, etc. ... on the website of Atelier Jupe are only approximate and indicative, and cannot give rise to any compensation of any sort or termination of the agreement. Colors may differ from reality to a certain extent.

Force Majeure

Atelier Jupe cannot be held liable if her obligations cannot be met due to force majeure. Force majeure means any cause or circumstance that prevents Atelier Jupe from fulfilling its obligations: delays in or breach of contract by suppliers and deliverers, disruptions in the Internet, disruptions in electricity, disruptions in e-mail traffic and disruptions or changes in technology supplied by third parties, transport difficulties, strikes, government measures, delays in supply, negligence of suppliers and / or manufacturers or of auxiliaries, illness of staff, defects in aids or means of transport, delivery is explicitly considered as force majeure. In the event of force majeure, Atelier Jupe reserves the right to suspend her obligations and is also entitled to dissolve the agreement in whole or in part, or to claim that the content of the agreement be changed in such a way that execution remains possible. Under no circumstances is Atelier Jupe obliged to pay any fine or compensation of any sort. If, upon beginning of the force majeure, Atelier Jupe has already partially fulfilled her obligations, or can only partially meet her obligations, she is entitled to invoice the goods that have already been delivered separately and the customer is obliged to settle this invoice as if it were a separate contract.

Retention of ownership

Atelier Jupe retains ownership of all goods and services sold and delivered by Atelier Jupe as long as the buyer has not paid the claims of Atelier Jupe under the agreement or previous or later similar agreements, or as long as the buyer has not paid the claims of Atelier Jupe for failing to fulfil such obligations, including claims for fines, interest and costs, etc. The buyer is not authorised to pledge the goods that fall under the retention of title nor to encumber them in any other way. The customer undertakes to insure the goods delivered under retention of title and to keep them insured against fire, explosion and water damage as well as against theft and to give the policy of this insurance for inspection to Atelier Jupe upon first request.

Payment

Delivery will only take place after the invoice amount has been received. If payment has not been received within 3 working days, the contract conditions will be reviewed. Ordered goods are reserved 3 working days without payment.

Applicable law / competent court

Belgian law applies to all agreements. In the event of a dispute, only the Dutch-speaking courts of Mechelen have jurisdiction.

Cancellation and refund policy

In accordance with the Distance Selling Act (article 49 and the following one of 6 April 2010), the buyer has the right to return (part of) the delivered goods within a period of 14 working days without giving a reason. This period starts when the ordered items have been delivered. The buyer is obliged to immediately check the delivered goods upon receipt. The customer must inform Atelier Jupe in advance of the fact that a shipment will be returned. The return of the delivered goods is entirely at the expense and risk of the buyer. If the customer has not returned the goods delivered to Atelier Jupe after the term of 14 working days, the purchase is a fact. The customer must prove that the goods delivered were returned on time, for example by means of a proof of postal delivery. Return of the goods is only possible in the original or similar packaging and without any traces of use (stains, damage, cuts, etc.). All cut fabrics and haberdashery can only be returned with a minimum length of 50 cm or a multiple thereof. When all conditions are met, Atelier Jupe ensures that the full purchase amount is refunded to the buyer within 30 days after the receipt of the return shipment.

Shipping and payment

The packages are sent with BPost. The shipping costs within Belgium are 4,95 euros, shipping is free starting from 95 euros per purchase. To the Netherlands the shipping costs are 7,50 euros, shipping is free starting from 125 euros per purchase. To Germany the shipping costs are 7,95 euros, shipping is free starting from 125 euros purchase. To France the shipping costs are 9,5 euros, shipping is free starting from 125 euros per purchase. Atelier Jupe cannot be held liable for damage or loss after the package has been processed at BPost.

For destinations other than Belgium, the Netherlands, France or Germany, please contact Atelier Jupe via info@atelierjupe.com. 

Standard shipping has no insurance, but this can be arranged by sending an e-mail to info@atelierjupe.com just after your order. The extra insurance cost of a package is 1,50 euros.

The different payment options are offline payment, payment with Bancontact or payment with a credit card. If you choose to pay offline, you will receive an email after your order with the necessary instructions. After receiving the payment, the package is prepared for shipment. Payments with credit card always happen in a secure environment.

When your order is completed, you will always receive a confirmation email. If this is not the case, please contact Atelier Jupe at info@atelierjupe.com
